1. Acceptance of Terms
By accessing or using GovBidly ("the Service"), operated by GovBidly ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
GovBidly is a subscription-based platform that aggregates, organizes, and presents government contract opportunities sourced from SAM.gov. We provide search, filtering, and alert tools to help small businesses discover and track federal contracting opportunities.
GovBidly does not guarantee the accuracy, completeness, or timeliness of contract data. Users should verify all information directly on SAM.gov before submitting bids or proposals.
3. Accounts
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to use the Service
- One person or entity per account — sharing login credentials is prohibited
- You are responsible for all activity that occurs under your account
4. Subscription Plans & Billing
- GovBidly offers paid subscription plans (Starter, Pro, Agency) with a 5-day free trial
- Billing begins after the trial period unless you cancel before it ends
- Subscriptions renew automatically at the end of each billing cycle (monthly or annual)
- All payments are processed securely through Stripe
- Prices are listed in USD and may be updated with 30 days' notice to existing subscribers
5. Cancellation & Refunds
- You may cancel your subscription at any time from your account dashboard
- Cancellation takes effect at the end of your current billing period — you retain access until then
- We offer a 30-day money-back guarantee for first-time subscribers
- Refund requests after 30 days are handled on a case-by-case basis

6. Acceptable Use
You agree not to:
- Use automated scripts, bots, or scrapers to extract data from the Service
- Resell, redistribute, or commercially exploit GovBidly data or features
- Attempt to gain unauthorized access to other accounts or our systems
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service or its infrastructure
7. Data Accuracy Disclaimer
Contract data on GovBidly is sourced from SAM.gov and other public government databases. While we strive to keep data accurate and up-to-date, we make no warranties regarding the completeness, accuracy, or reliability of any contract listing. Always verify opportunity details directly with the contracting agency before taking action.
8. Intellectual Property
The GovBidly name, logo, website design, and proprietary features are owned by us. Government contract data sourced from SAM.gov is public information and is not claimed as our intellectual property. You may not copy, modify, or distribute our proprietary platform features without written permission.
9. Limitation of Liability
To the maximum extent permitted by law, GovBidly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control (including SAM.gov API outages). We are not liable for any losses due to service downtime.
11. Termination
We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Any fees already paid are non-refundable unless covered by our 30-day guarantee.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
